Success Story: I-130, I-485 and I-601 for a Child of Legal Permanent Resident

Our firm recently obtained a I-601 waiver and forms I-130 and I-485 for a Serbian national who is a child of a legal permanent resident of the United States. To complete the applications Blue Lake Law had to navigate through foreign custody issues. Our client and her parents have sincere moral convictions against vaccines so our firm had to file an I-601 waiver. Refusal to meet US vaccination requirements based on moral and or religious convictions must file a waiver to request for the requirement to receive vaccines to be ‘waived’ under the certain grounds that make them ineligible for a Green Card or visa. Blue Lake Law assisted in gathering evidence and creating a sworn statement for our client’s I-601 waiver, which was approved! 

The client’s biological parents are no longer together, during the time of filing her father had joint custody from a country abroad. To ensure the custody agreement could be honoured so the child could still obtain the green card, our firm filed and expedited I-131 advanced parole form for her. To expedite the I-131 form a request is sent to the USCIS to speed up the approval of travel documents for urgent, unplanned, or humanitarian situations, typically reducing processing times significantly. It is for individuals with pending Form I-485 applications needing to leave the U.S. immediately. The expedited form was approved, allowing the child to meet custody requirements. 

Once the requirements were met our client was able to file forms I-130, Petition for Alien Relative, and I-485, an Adjustment of Status. The child is on her way to becoming a US citizen and Green Card holder, allowing her to reside in the United States with her mother. This case was a huge success for our firm. We had to navigate through immigration proceedings from the US, Serbia, and a third country to file the usually straight forward I-130 and I-485 forms.
