Success Story: Approval of a K-1 Visa Through Frankfurt

 

Our client, a German national engaged to a US citizen, requested our firm’s help with their initial I-129F, Petition for Alien Fiancé(e). The I-129F is a form used by US citizens to bring a foreign fiancé(e) to the US. It requires proof of a valid, in-person relationship within the last 2 years, with current processing times taking 8–11 months. Our firm coordinated with the US Consulate General in Frankfurt and was able to obtain an approval, despite a prior US visa overstay. It is generally difficult to get a visa approved after a prior overstay, as it is a major breach of immigration rules. It often triggers mandatory refusal periods, such as a 12-month ban for overstaying more than 30 days in the United States. However, approval is possible if you can provide a valid, documented reason for the overstay or if it was a short, 14-day, or less, period.
