Success Story: Approval of a K-1 Visa for a Dutch National with a Previous Assault Case

 

Our client previously was charged with a simple assault conviction (Article 300 mishandling in Dutch). The Dutch national contacted our firm to help them with obtaining a K-1 finance(e) visa despite having a conviction. Under U.S. immigration law, certain criminal convictions can make a foreign national inadmissible to the United States, meaning they can be denied a visa or entry. This falls under the grounds of inadmissibility outlined in the Immigration and Nationality Act (INA). The most common conviction-related reasons include a crime involving a crime involving moral turpitude, this often leads to immigration cases becoming inadmissible. 

 

However, our team was able to argue that the past conviction of our client is not a crime of moral turpitude, thus this case was deemed to be admissible, allowing the Dutch national to obtain a K-1 visa. 

 

After a short liaison with the U.S. Consulate General in Frankfurt and a couple of days of administrative processing, our client’s case was adjudicated. Our client was approved for their K-1 visa! Our firm would like to extend a huge congratulations to our client and their fiance(e).
