Our client, a U.S. citizen, received a job offer requiring her to relocate to the U.S. in 3 months. During this time she was living in Spain with her Spanish husband. They wanted to relocate to the U.S. together, but because of the job offer requiring a short-notice move, they didn’t have enough time for a standard domestic USCIS, so they reached out to Blue Lake Law to request Direct Consular Filing (DCF). 

 

DCF allows a U.S. citizen petitioner living abroad to file Form I-130 directly with their local U.S. Embassy instead of through USCIS, often cutting processing time to just a couple of months. If you’re a U.S. citizen residing in Spain and you (the petitioner) receive a job offer or reassignment in the U.S. with very little notice for your start date, this can qualify as an “exceptional circumstance” warranting DCF.

 

 In Spain, DCF is available only in exceptional circumstances, and approval of a DCF request is entirely at the discretion of the Consular Section in the US Embassy in Madrid, so it’s important to clearly document the timeline of your job offer and the urgency of your relocation when submitting your request.
