Success Story: Approval of an E-2 Dependent Visa for a Spouse in China 

Our client, a Dutch company based in the U.S., petitioned for an E-2 Visa for one of their Dutch employees who works in a specialized knowledge capacity. The employee was already living and working in the U.S. at the time when the company reached out for our help. Their employee wanted his wife to join him in the U.S. while he is working for the Dutch company. His wife is a Chinese national who was residing in China during this time. 

The spouse of an E-2 visa holder qualifies for derivative E-2 status and can accompany them to the U.S.. They can do this by applying alongside the principal E-2 holder, or after the E-2 holder has already been approved. In our case, the E-2 holder’s wife applied for her E-2 dependent visa after he was already approved and working in the States. E-2 dependent spouses are considered employment-authorized incident to status, they can generally work in the U.S. without needing to file a separate application. 

The status of an E-2 dependent is directly linked to the status of the principal E-2 holder, however, the wife of the E-2 holder can work anywhere, while her husband is only allowed to work at the Dutch company who sponsored and petitioned for his E-2 visa.
