What is an E1 visa?
The USA E1 visa is a non-immigrant resident visa that will allow you to visit the United States for business and trade-related activities including the purchase and sale of physical goods or services.
E1 visa eligibility
To be eligible for an E1 treaty trader visa in the USA:
Be a citizen of a US trade treaty country
These include:
Argentina, Australia, Bolivia, Bosnia & Herzegovina, Brunei, Canada, Chile, China, Costa Rica, Ethiopia, Honduras, Israel, Japan, Jordan, Kosovo, Liberia, Macedonia, Mexico, Montenegro, New Zealand, Norway, Oman, Pakistan, Paraguay, Philippines, Serbia, Singapore, South Korea, Suriname, Switzerland, Taiwan, Thailand, Togo, Turkey, the United Kingdom and all EU member states.
Substantial trade
This means there needs to be a continuous flow of goods or services between your home country and the USA.
Applicant conditions
The employee applying for the E1 visa must play a substantial role in the business including being a manager, a specialist in their field or an executive.
E1 visa validity
Length of an E1 visa
An E1 visa can be valid for a period of up to five years initially but can be extended or renewed indefinitely providing the eligibility criteria is fulfilled.
US residency
You will be able to continuously reside in the USA for as long as your E1 visa is valid.
Family
Your husband or wife, along with unmarried children under 21 years of age are eligible to reside in the USA with you under an E1 visa.
Work limitations
On an E1 visa, you can only carry out work relating to the trading activities stated or for the company that’s sponsoring you, however, spouses can apply for work authorization which will allow them to work for any employer.
