Our client, a Dutch national married to a U.S. citizen, reached out to our firm so we could help them secure a green card. The I-130 petition for alien relatives is the form that a U.S. citizen or lawful permanent resident files with USCIS to establish a qualifying family relationship with a foreign relative, essentially proving the relationship is legitimate so that person can eventually immigrate to the U.S. While the immigrant visa is the actual travel document issued by the U.S. consulate or embassy abroad. It allows the foreign relative to enter the U.S. and become a green card holder. In short, the I-130 establishes eligibility based on the family relationship, while the immigrant visa is what actually lets the person travel to and enter the U.S.

In this particular case our firm had to send our client’s case to the U.S. Consulate General in Frankfurt, rather than working with the consulate in Amsterdam. This is because Amsterdam has stopped handling routine immigrant visa services like consular processing and visa interviews. The consulate in Frankfurt was then designated as the regional U.S. consulate covering the Netherlands. Luckily for Dutch nationals they can just mail their applications and documents to the consulate in Frankfurt, rather than having to go in person. 

After continuous contact with the Frankfurt consulate and our client, our firm was able to secure an approval for their I-130 petition. Following that, our client’s travel document was issued and approved by the U.S. Consulate General in Frankfurt!
