Success Story: Approval of an I-485 Form and I-601 Vaccine Waiver for a Foreign Parent of a US Citizen
Our client, a Chinese national who is a parent of a US citizen, entered the US on a B visa with an already pending I-130 form, filed in advance by their child. Entering the US on a B-1/B-2 visa means you are permitted temporary entry (usually up to 6 months) for business consultations, tourism, or medical treatment, while maintaining a foreign residence. It acts as a non-immigrant visitor visa for short-term stays, prohibiting paid employment, study, or permanent residency, with typical, strict, and no-grace-period departures required. The client came to our firm for assistance with their I-485 adjustment of status application. This is filed after the I-130 form is filed, in this case our client was in the US during the approval, but needed to file an I-485 to remain permanently. Our firm also assisted with their I-601 vaccine waiver. We completed the applications and focused on our client’s sincere moral beliefs against vaccinations of any kinds to provide a strong argument for their adjustment of status. We recommended that the client take a copy of the waiver application to her green card interview which sped up the processing of the waiver, leading to approval around one week after the interview and the green card being received about two weeks after the interview.
