Success Story: Approval of Form I-130, Form I-485, and I-601 Waiver for a Spanish National
Our client, a Spanish national married to a U.S. citizen, entered the U.S. with her husband on an ESTA. While in the U.S. she decided she wanted to stay there with her husband indefinitely. Because our client would only be able to stay in the U.S. for 90 days under the ESTA, our firm assisted our client in the immigration process to secure her green card.
Her husband first filed the I-130 petition for an alien relative, once it was approved our client also applied for an Adjustment of Status (AoS) to get her green card. However, before the AoS could be properly processed and approved our firm had to file an I-601 vaccine waiver for our client, due to their strong convictions against being vaccinated.
The I-601 waiver (Application for Waiver of Grounds of Inadmissibility) may be needed for vaccinations because U.S. immigration law requires all applicants for immigrant visas or adjustment of status to meet specific vaccination requirements as a condition of admissibility. If an applicant is unable to comply with these vaccination requirements due to a medical contraindication, religious beliefs, or moral convictions they must file an I-601 waiver to request an exemption and avoid being deemed inadmissible to the United States.
USCIS approved the vaccine waiver and as a result our client’s AoS was also approved. The entire process took approximately 8 months from submission of the first form. Our client is now residing in the U.S. as a green card holder, residing with her husband! Our firm would like to extend a huge congratulations to the couple!
