Success Story: Approval of Form I-130, Form I-485, and I-601 Waiver for an Irish National 

 

Our client, an Irish national married to a U.S. citizen, entered the States with his wife on an ESTA. An ESTA (Electronic System for Travel Authorization) is an automated online system that determines the eligibility of visitors to travel to the United States under the Visa Waiver Program, allowing citizens of certain countries to visit for up to 90 days without needing a full visa. It is not a visa itself, but rather a pre-travel authorization that must be approved before boarding a US-bound flight or vessel. 

 

Since our client wanted to stay with his wife in the U.S. indefinitely, he reached out to our firm for immigration help. To start off we filed the I-130 Petition for an Alien Relative, once it was approved we then filed an Adjustment of Status (AoS), Form I-485, to secure his green card. However, due to prior strong moral convictions for not wanting to be vaccinated, our firm also had to file an I-601 vaccination waiver. 

 

The I-601 waiver (Application for Waiver of Grounds of Inadmissibility) is needed for vaccinations because U.S. immigration law requires all applicants for immigrant visas or AoS applicants to meet specific vaccination requirements as a condition of admissibility. If an applicant is unable to comply with these vaccination requirements, due to a medical contraindication, religious beliefs, or moral convictions, they must file an I-601 waiver to request an exemption and avoid being deemed inadmissible to the United States.

 

Our firm was able to successfully secure approvals for both forms and the vaccination waiver. He was able to obtain his green card within 10 months of filing the initial form! Our client is now able to live in the U.S. with his wife!
