Success Story: E-2 for a Dutch National Completed in 6 Weeks

Our team at Blue Lake Law successfully helped our client, a Dutch national, to obtain their E-2 within 6 weeks from the date it was submitted in the U.S. consulate in Amsterdam. An E-2 visa is a ‘Treaty Trader’ visa which is based on a special treaty between the Netherlands and the United States which has been in force since 1957. This treaty, which is often referred to as the Dutch American Friendship Treaty (DAFT), is only applicable to Dutch citizens, although other countries have similar treaties with the United States. The treaty states that a Dutch citizen is eligible for a E-2 visa if they invest in the United States, this is usually by starting or buying a business. This business has to create at least one U.S. job. In this case our client is investing in the U.S. by building a property management company in Florida. The E-2 visa is valid for three years and potentially renewable indefinitely as long as the investment (business) continues to exist. 

Obtaining an E-2 visa in 6 weeks is an excellent result! Historically the E-Visa unit in the U.S. consulate in Amsterdam has taken much longer to adjudicate E-2 visas. In fact 6 weeks is a quicker turnaround time compared to most E-Visa units in Europe. E-2 visas go through the Department of State (the consulate or embassy in the country of the applicant’s residence) instead of the Department of Homeland Security (located in the United States), meaning you get country specific experts adjudicating your case.
