Our client, a British national, is married to a U.S. citizen who is currently residing in the States. Under current U.S. Citizenship and Immigration Services (USCIS) guidelines, a public charge is defined as a noncitizen who is likely to become primarily dependent on the government for income maintenance or long-term institutionalization at government expense.
