On-the-spot Approval of an I-130, I-485, and I-601 Vaccine Waiver During Interview 

Our client, a Canadian national married to a US citizen, requested to file applications for the I-130, I-485, and I-601 (vaccine) waivers. All applications were filed concurrently and during the Adjustment of Status interview, all three applications were approved. This is rare because the I-601 waiver isn’t usually adjudicated at the interview stage and often takes a couple more weeks to be approved. The I-130 waiver is an application to file a petition for an alien relative. In this case, our client’s spouse filed an application to establish a qualifying relationship with a foreign relative who wants to immigrate to the US (our client who is a Canadian citizen). 

 I-485 waivers are the application that the foreign national wishing to immigrate to the US files. The I-485 deals with adjustment of status or applying for a lawful permanent resident status, so the foreign national can obtain a green card. 

I-601 vaccine waivers are the application which allows Green Card applicants to avoid violating their sincerely held moral beliefs against vaccines of all kinds while still obtaining their Legal Permanent Residence.
